Store Regulations of the www.ultrasstickers.eu Online Store

Defining, among others, the rules for concluding sales contracts through the Store, containing the most important information about the Seller, the Store, and Consumer Rights.

§ 1 Definitions

Business Days – days from Monday to Friday, excluding public holidays.

Account – a free Store function (electronic service), regulated by separate terms, through which the Buyer may create an individual Account in the Store.

Consumer – a consumer within the meaning of the Polish Civil Code.

Buyer – any entity making purchases in the Store.

Regulations – these Terms and Conditions.

Store – the Ultrasstickers online store operated at www.ultrasstickers.eu.

§ 3 Technical Requirements

For the proper functioning of the Store, the following are required:

  • a device with Internet access,
  • a web browser supporting JavaScript and cookies.

To place an order in the Store, in addition to the requirements specified above, an active email account is required.

§ 4 Purchases in the Store

  1. The prices of goods visible in the Store are total prices for the goods, including VAT.
  2. The total price of the order consists of the price of the goods and, where applicable, delivery costs.
  3. The goods selected for purchase should be added to the cart in the Store.
  4. The Buyer then chooses from the options available in the Store: the delivery method and the payment method, and provides the data necessary to complete the order.
  5. The order is placed when the Buyer confirms its content and accepts these Regulations.
  6. Placing an order is equivalent to concluding a sales contract between the Buyer and the Seller.
  7. The Seller shall provide the Consumer with confirmation of the conclusion of the sales contract on a durable medium at the latest upon delivery of the goods.
  8. The Buyer may register in the Store, i.e. create an Account, or make purchases without registration by providing the required data each time.
  9. Foreign shipments are sent at the responsibility of the ordering person. The Seller is not responsible for parcels lost or undelivered in international shipping.

§ 5 Payments

The Buyer may pay for the order, depending on the chosen payment method:

  • by ordinary bank transfer to the Seller’s bank account,
  • through the payment platforms: Przelewy24, PayPal, Skrill,
  • cash on delivery, i.e. in cash upon delivery of the goods to the Buyer (only in Poland),
  • cash upon personal collection.

If the Buyer chooses advance payment, the order must be paid within 2 Business Days from placing the order.

The Seller informs that, in the case of some payment methods, due to their specific nature, payment is possible only immediately after placing the order.

The Buyer, by making purchases in the Store, accepts the use of electronic invoices by the Seller. The Buyer has the right to withdraw this acceptance.

§ 6 Order Fulfillment

  1. The Seller is obliged to deliver goods free from defects.
  2. The order completion time is indicated in the Store.
  3. If the Buyer has chosen to pay in advance, the Seller will start processing the order after payment is received.
  4. If, within one order, the Buyer purchased goods with different completion dates, the order will be completed within the period applicable to the goods with the longest completion time.
  5. Goods purchased in the Store are delivered depending on the delivery method selected by the Buyer:
    • personal collection at the company’s registered address during opening hours,
    • courier delivery,
    • InPost parcel lockers (only in Poland),
    • own transport.
  6. If the Buyer chooses personal collection, the goods will be ready for pickup on the indicated completion date.
  7. Foreign shipments are sent at the responsibility of the ordering person. The Seller is not responsible for parcels lost or undelivered in international shipping.

§ 7 Right of Withdrawal

  1. The Consumer has the right to withdraw from the contract concluded with the Seller through the Store, subject to § 8 of these Regulations, within 14 days without giving any reason.
  2. The withdrawal period expires after 14 days from the day:
    • on which the Consumer acquired possession of the goods, or on which a third party other than the carrier and indicated by the Consumer acquired possession of the goods,
    • on which the Consumer acquired possession of the last item, or on which a third party other than the carrier and indicated by the Consumer acquired possession of the last item, in the case of a contract involving multiple goods delivered separately,
    • of the conclusion of the contract, in the case of a contract for the supply of digital content.
  3. To exercise the right of withdrawal, the Consumer must inform the Seller, using the contact details provided in § 2 of these Regulations, of the decision to withdraw from the contract by means of an unequivocal statement (for example, a letter sent by post or information sent by email).
  4. The Consumer may use the model withdrawal form provided at the end of these Regulations, but this is not mandatory.
  5. To meet the withdrawal deadline, it is sufficient for the Consumer to send information concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

  1. In the event of withdrawal from the contract, the Seller shall return to the Consumer all payments received from the Consumer, excluding the costs of delivery of the goods, without undue delay and in any event not later than 14 days from the day on which the Seller received the returned shipment.
  2. The Seller will refund the payment using the same payment methods that were used by the Consumer in the original transaction, unless the Consumer and the Seller agree otherwise.
  3. The Seller may withhold the refund until the goods are received back.
  4. The Seller requests that the goods be returned to the following address: ul. Ogrodowa 167, 33-300 Nowy Sącz, Poland, immediately and in any case not later than 14 days from the day on which the Consumer informed the Seller about the withdrawal from the sales contract.
  5. The deadline is met if the Consumer sends back the goods before the period of 14 days has expired.
  6. The Consumer bears the direct cost of returning the goods.

§ 8 Exceptions to the Right of Withdrawal

The right to withdraw from a distance contract does not apply to contracts:

  • for the supply of non-prefabricated goods made according to the Consumer’s specifications or clearly personalized,
  • for the supply of goods which are liable to deteriorate or expire rapidly,
  • for the supply of goods delivered in a sealed package which are not suitable for return due to health protection or hygiene reasons, if the package was opened after delivery,
  • for the supply of goods which, after delivery, are inseparably mixed with other items due to their nature,
  • for the supply of sound or video recordings or computer software delivered in a sealed package, if the package was opened after delivery,
  • for the supply of newspapers, periodicals or magazines, except for subscription contracts,
  • where the price or remuneration depends on fluctuations in the financial market which cannot be controlled by the Seller and which may occur before the withdrawal period expires,
  • for the supply of digital content not supplied on a tangible medium if performance has begun with the Consumer’s express consent before the expiry of the withdrawal period and after the Consumer was informed about the loss of the right of withdrawal.

The right of withdrawal from a distance contract is not available to an entity other than the Consumer.

§ 9 Complaints

  1. In the event of a defect in the goods, the Buyer has the right to submit a complaint under the warranty rights provided for in the Polish Civil Code, unless a separate guarantee has been granted.
  2. Using warranty rights, the Buyer may, under the conditions and within the time limits specified in the Polish Civil Code:
    • submit a statement requesting a price reduction,
    • in the case of a material defect, submit a statement of withdrawal from the contract,
    • demand replacement of the goods with defect-free goods,
    • demand removal of the defect.
  3. The Seller requests that complaints under warranty be submitted to the postal or electronic address indicated in § 2 of these Regulations.
  4. If it turns out that in order to consider the complaint it is necessary to deliver the complained goods to the Seller, the Buyer is obliged to deliver those goods at their own expense to the following address: Ultras Mariusz Nowak, ul. Ogrodowa 167, 33-300 Nowy Sącz, Poland.
  5. If an additional guarantee has been granted for the product, information about it and its terms is available in the product description in the Store.
  6. Complaints regarding the operation of the Store should be sent to the email address provided in § 2.
  7. The complaint will be considered by the Seller within 14 days.

Out-of-Court Complaint Handling and Claim Enforcement

If the complaint procedure does not bring the result expected by the Consumer, the Consumer may use, among others:

  • mediation conducted by the competent Provincial Inspectorate of Trade Inspection,
  • assistance of a permanent amicable consumer court operating at the Provincial Inspectorate of Trade Inspection,
  • free assistance from the municipal or district Consumer Ombudsman,
  • the ODR online platform available at: http://ec.europa.eu/consumers/odr/

§ 10 Personal Data

The controller of the personal data provided by the Buyer while using the Store is the Seller.

The Buyer’s personal data is processed primarily on the basis of the contract and for its performance, in accordance with the principles set out in the General Data Protection Regulation (GDPR).

Detailed information on data processing by the Seller is included in the privacy policy posted in the Store.

§ 11 Final Provisions

  1. The Buyer is prohibited from providing unlawful content.
  2. Each order placed in the Store constitutes a separate sales contract and requires separate acceptance of these Regulations.
  3. The contract is concluded for the time necessary to complete the order.
  4. Contracts concluded on the basis of these Regulations are concluded in English and/or Polish, depending on the language version made available by the Store.
  5. In the event of a dispute with a Buyer who is not a Consumer, the competent court shall be the court having jurisdiction over the Seller’s registered office.
  6. None of the provisions of these Regulations excludes or in any way limits the Consumer’s rights under mandatory provisions of law.
  7. The provisions regarding goods and the sales contract shall apply accordingly to digital content and contracts for the supply of digital content, unless these Regulations provide otherwise.

§ 1 Definitions

Account – a free Store function regulated by these terms, through which the Buyer may create an individual Account in the Store.

Buyer – any entity making purchases in the Store.

§ 3 Technical Requirements

For proper functioning and creation of an Account, the following are required:

  • an active email account,
  • a device with Internet access,
  • a web browser that supports JavaScript and cookies.

§ 4 Account

  1. Creating an Account is entirely voluntary and depends on the Buyer’s decision.
  2. The Account gives the Buyer additional options, such as:
    • viewing the history of orders placed in the Store,
    • checking order status,
    • editing the Buyer’s data.
  3. To create an Account, the Buyer should fill in the appropriate form in the Store.
  4. At the moment of creating the Account, an agreement for an indefinite period is concluded between the Buyer and the Seller for maintaining the Account under the terms set out in these regulations.
  5. The Buyer may resign from the Account at any time without incurring any costs.
  6. To delete the Account, the Buyer should send a resignation to the Seller at: [email protected], which will result in immediate deletion of the Account and termination of the Account maintenance agreement.

§ 5 Complaints

  1. Complaints regarding the operation of the Account should be sent to: [email protected]
  2. The complaint will be considered by the Seller within 14 days.

Out-of-Court Complaint Handling and Claim Enforcement

If the complaint procedure does not bring the result expected by the Consumer, the Consumer may use, among others:

§ 7 Final Provisions

  1. The Buyer is prohibited from providing unlawful content.
  2. The Account maintenance agreement is concluded in English and/or Polish, depending on the language version made available by the Store.
  3. The Seller has the right to amend these Account Regulations for important reasons, in particular:
    • the need to adapt the Store to legal provisions applicable to the Store’s operations,
    • improving the security of the service provided,
    • changes in the functionality of the Account requiring modification of these Regulations.
  4. The Buyer will be informed of any planned change to the Account Regulations at least 7 days before the change takes effect, by email sent to the address assigned to the Account.
  5. If the Buyer does not accept the planned change, they should inform the Seller by sending an appropriate message to: [email protected], which will result in termination of the Account maintenance agreement upon the planned change taking effect, or earlier if requested by the Buyer.
  6. If the Buyer does not object to the planned change before it takes effect, it is assumed that the Buyer accepts it, which does not prevent termination of the agreement in the future.
  7. In the event of a dispute with a Buyer who is not a Consumer, the competent court shall be the court having jurisdiction over the Seller’s registered office.
  8. None of the provisions of these Regulations excludes or in any way limits the Consumer’s rights under mandatory provisions of law.

§ 8 User Conduct

By using this Site, you agree not to:

  • upload, download, post, email, or otherwise transmit any content that is unlawful, harmful, threatening, abusive, vulgar, harassing, defamatory, obscene, pornographic, profane, indecent, inflammatory, libelous, tortious, hateful, racially, ethnically, socially, politically, legally, morally, or religiously objectionable, or otherwise objectionable, or invasive of another person’s rights, including rights of privacy, publicity, or intellectual property;
  • impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;
  • upload or transmit any content that may infringe any patent, trademark, trade secret, copyright, or other proprietary rights of any party;
  • upload or transmit any content that would constitute or encourage a criminal offense, violate the rights of any party, or otherwise create liability or violate any local, national, or international law;
  • upload or transmit unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, or any other form of solicitation;
  • upload or transmit any material containing software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any software, hardware, or telecommunications equipment;
  • upload or transmit false or misleading information;
  • disrupt or interfere with the security of the Site or any related services, systems, servers, or networks;
  • access, tamper with, or use non-public areas of the Site;
  • disrupt or interfere with any other user’s enjoyment of the Site;
  • frame or link to the Site except as permitted in writing by the Seller;
  • incorporate images or names that would violate a person’s right of privacy or publicity.

You acknowledge that the Seller may review uploaded content and orders for compliance with these rules and applicable law, and may reject or remove content that violates these rules or is otherwise objectionable.

Privacy Policy

Your privacy is very important to Ultras Mariusz Nowak. Users of this Site should refer to the Privacy Policy available at www.ultrasstickers.eu for information about how personal information is collected and used.

Proprietary Rights

You acknowledge and agree that any content, including but not limited to text, data, photos, graphics, and other materials contained or distributed on or through the Site, is protected by trademarks, service marks, patents, copyrights, or other proprietary rights and laws.

You may not use or distribute any content received through the Site without the authorization of the content owner. You retain all ownership rights to your content submitted to the Site. By submitting content to the Seller, you grant the Seller a non-exclusive, worldwide, transferable license to use, copy, reproduce, modify, publicly display, and distribute your content for the purpose of fulfilling the order and operating the Store.

Intellectual Property Policy

The Seller respects the intellectual property rights of others and expects users to do the same.

Limitation of Liability

To the fullest extent permitted by law, the Seller shall not be liable for any indirect, incidental, special, consequential, or exemplary damages resulting from the use of, or inability to use, the Site, except where such liability cannot be excluded under mandatory law.
